The sale of products and services by Kevin Gallagher T/A KGP Motorsport & KGP Engineering are subject to these Terms and Conditions.
Products can be bought in store. However if a product is reserved for another customer KGP Motorsport reserve the right to refuse the sale.
Orders can be placed via email or on the telephone. These orders must be confirmed by KGP Motorsport.
If an order has been placed specially for a customer or a product manufactured to a customer’s specifications then these orders cannot be cancelled if the product has been shipped/manufactured.
The customer also has the right to cancel orders within 24hrs after placement of the order.
KGP Motorsport reserve the right to refuse any offer to purchase prior to written confirmation or dispatch. Where goods ordered become unavailable, the price of goods varies or an error is made in the price, description or for some other reason, a full refund will be made to the customer, usually in the method it was made to KGP Motorsport.
Pricing and payment
Whilst we do our best to ensure prices are up to date and correct, errors may occur and in this case we’ll contact you before your order is shipped. Prices are subject to change at any time.
Prices are to be paid in € sterling, unless otherwise agreed.
Payment must be received before products will be dispatched or released.
Products can be delivered worldwide but are subject to a charge depending of product size, weight and destination. Delivery prices will be quoted to the customer if requested for approval before being dispatched. Products will either be dispatched by courier, An Post or Royal Mail.
If part of an order is not in stock the customer will be contacted to confirm whether to ship an incomplete order or to wait until the full order is available.
Shipping times are all estimates and KGP Motorsport shall not be liable for any loss or damage whatsoever due to failure by them to deliver the goods promptly or, if prevented by events beyond KGP Motorsport reasonable control.
Orders when In stock will be dispatched within 2 working days, delivery times will vary but within Ireland should take approximately 3 working days, UK deliveries approximately 5 working days and deliveries within Europe approximately 7 working days. These are all estimated delivery times.
For orders placed from within the EU, prices are subject to VAT (Value Added Tax) charged at a rate of 23%. VAT does not apply to orders that are to be shipped outside the EU or to tax-free areas such as the Channel Islands. These areas will be priced and billed with VAT deducted. Please note that local tax and customs duty may apply. For full details please consult your local customs office.
Product(s) can be returned if they are deemed unsuitable. However there are some limitations as to what can be returned.
- Items cannot be accepted if any of the products have been specially ordered for a customer or manufactured to a customer’s specification.
- If products are being returned by post/courier, this should be arranged and paid for by the customer. Responsibility will not be accepted by KGP Motorsport for returned parcels which are damaged or undelivered. The customer should retain proof of postage should they need to file a claim with their carrier.
- Products must be returned in the same condition they were sold in. Damaged or used goods cannot be accepted.
- Products must be returned in the original packaging, if applicable.
- Products must be returned within 90 days and meet the above criteria in order to secure a refund. It is felt this is a generous time frame.
Product(s) that have been returned, and satisfy our returns policy, will be issued a refund through the same method as payment was received. This will be processed within 24hrs of the return.
KGP Motorsport will transfer to the customer any product warranties and indemnities authorised by the manufacturer. Outside of this KGP Motorsport do not offer any other warranty system. All guarantees for products are provided entirely by the manufacturers and are subject to terms contained therein. Customers are reminded to complete and return all warranty cards/documents upon receipt of goods where appropriate.
KGP Motorsport is not liable for failure to fulfill its obligations for any accepted order or for delays in delivery due to causes beyond its reasonable control, (for example: acts of God, acts or omissions of the Customer, man-made or natural disasters, epidemic medical crises, materials shortages, strikes, acts of terrorism, delays in transportation, or inability to obtain labour or materials through its regular sources).
Use of Products
KGP Motorsport cannot accept responsibility for products which are used in a manner different to that of manufacturers’ instructions or general product misuse. Damage to the product, personal injury or loss of life, etc. as a result of misuse is not KGP Motorsport responsibility. Misused items will not be accepted for return. KGP Motorsport will not accept liability for products which are modified.
Competition goods are supplied for specialist use and are subject to extreme heat and stress whilst in use. Competition use can involve exceptional and unpredictable loadings. Life expectancy and durability are greatly reduced and purchasers should note that any claim for failure/wear, shall not be entertained by KGP Motorsport. It is acknowledged by the customer of such goods that the foregoing statement shall be a relevant and important issue in any claim brought against KGP Motorsport. Customers should also note, parts connected to parts supplied by KGP Motorsport may be placed under stress where specialist/competition parts are used, and customers should take advice from experts prior to purchase. Manufacturers may also limit guarantees when components are installed for competition use.
Any photographs, samples, drawings, descriptions or advertising we issue, and any colours, images or illustrations, are offered solely to provide you with an approximate idea of the goods they describe. They do not form part of the contract between you and us for the sale of the goods. KGP Motorsport recommends customers validate any product information before using or acting on such information. All product information is subject to change without notice. KGP Motorsport is not responsible for typographical or other errors or omissions in product information.
At KGP Motorsport, your privacy is our priority. We are committed to protecting your privacy at all times, in all situations. The information we collect about you when you become a member is used to process your orders and to provide a more personalized experience on our site.
How Do We Use the Information We Collect?
When you become an KGP Engineering member, we ask you to fill out a form that requests your name, address and e-mail address as well as some demographic information such as gender and date of birth.
KGP Engineering will NOT share data with trusted partners to help us perform statistical analysis.
Your name and address information is used solely to process orders unless your prior consent is given. Without your consent, this information will NEVER be sold, given, rented or traded to others for purposes other than order fulfilment.
Your demographic information (gender, date of birth, etc.) will be used for several security purposes, to ensure you are who you say you are and in fact you are paying with your credit cards and not someone using your stolen credit cards.
Our Use of Log Files
When you visit our site we automatically log your IP address, your browser type and your access times. We utilize this information to conduct site performance evaluations, to see where visitors are coming from and to keep track of click stream data (the screens our users visit on our site). This data helps us to determine what content our members find most appealing so that we can maximize your enjoyment of the site. Log files are not tied to personally identifiable information.
All KGP Motorsport employees take your personal information very seriously. All employees must learn and obey our security policies. Access to member personal information is limited to key management personnel and our member services department. The information is ID and password protected and our Web security is reviewed on a monthly basis.
Correcting/Updating Your Personal Information
After becoming an KGP Motorsport subscriber you may correct/update your personal information by logging into your account, entering your ID, password and birth date when prompted and clicking the Edit Information button. The changes you make will be reflected in our databases instantly. If you wish to deactivate your account, you may contact our member services group through the ‘Contact Us’ section.
Links To Other Sites
From time to time we may send out email messages alerting you that products are available, to remind you about providing feedback or for promotional offers. In addition, you will receive communication from us 1) if you contact us for a particular reason, 2) to receive your orders, or 3) we need to contact you for administrative purposes such as winning a contest. Administrative e-mails will not contain promotional materials. If you choose to receive our News Letters, they will contain promotional materials from KGP Motorsport.
Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site
We may correct or supplement your address information with standardized postal representation in order to ensure that your orders are delivered. We do this since we want to make sure that our members receive the order and to lower costs associated with our programs.
Periodically, contests are run on our site. Sometimes contests are sponsored by our customers. To enter these contests you need only to enter your ID and password and your guess. At the time of entry, you may decide if you wish to have your first name and state posted on our site if you are the winner. Winner’s names are NEVER shared with our customers without their consent.
Cookies are pieces of information that your browser stores on your computer’s hard drive which identify you when you enter. The ability to select samples on our site is not cookie-driven. We may use session cookies to provide a seamless experience on the site and to combine with our log files so that we can understand our site traffic and analyze our demographic information in aggregate form.
